Any act that directly or indirectly infringes on farmers' rights, such as damaging water conservancy facilities, occupying or illegally using irrigation land, violating irrigation and drainage plans and management rules, obstructing waterways, discarding waste, or polluting water quality, as well as any behavior that disrupts the operation of water conservancy activities, is considered a violation. These violations should be addressed based on the severity of the case, following the procedures of advice, coordination, and reporting. If staff of this office face physical assault or obstruction while enforcing the law or reporting violations, they may request the court to handle the matter under obstruction of official duties.
The following actions are prohibited within the scope of irrigation facilities:
- Blocking irrigation channels
- Blocking canals
- Damaging ponds, irrigation channels, or associated structures
- Opening, moving, or damaging sluice gates or their auxiliary facilities
- Discarding waste soil or debris
- Extracting or piling up soil and stones
- Other actions that threaten the safety or function of irrigation facilities
- Illegal construction: Unauthorized construction or building of structures on irrigation land
- Illegal cultivation: Unauthorized planting of crops, bamboo, or trees on irrigation land
- Acts of violence or intimidation preventing personnel from performing their duties according to the law
- Coercing managers to open or close sluice gates or other control devices
- Advice: When disputes or violations occur (including when reported by farmers), the management personnel must immediately identify the involved parties and stakeholders, including names, ages, addresses, types of violations, time, location, and circumstances. For minor offenses, violators should be advised to voluntarily dismantle unauthorized structures and restore the area to its original state (in cases of occupation), comply with water distribution orders (in cases of water theft), or clear obstructions from waterways (in cases of blockage).
- Coordination: If advice does not resolve the issue, the area manager should gather evidence, investigate the facts (including photographing for documentation), and invite the head of the irrigation group, local stakeholders, and the involved parties to mediate and find a solution. The results of the coordination will be recorded in a report.
- Reporting: If the violation persists despite advice and coordination, the case will be reported to this office for legal action.
